  15. <p>A Smut Buster Battles Sin in the City Activist Dan Hurlbut
  16. crusades to stamp out pornography and prostitution in Houston
  17. </p>

  20. <p>    "Bust!"  With that crack of an undercover agent's voice on
  21. the Harris County sheriff's radio, an unmarked white Chrysler
  22. rips out of a gravel driveway. From other directions, four cars
  23. race down a seedy strip of highway toward an abandoned gray
  24. house. A vice raid is under way on Houston's north side, and
  25. alongside the sergeant in the Chrysler's front seat, citizen Dan
  26. Hurlbut, smut buster, unsheathes a dark cigar and relishes the
  27. upcoming catch.
  28. </p>
  29. <p>    In a city known for world-class pornography, Hurlbut has
  30. carved a swath of reform. An executive-search consultant in his
  31. more mundane life, the burly 59-year-old launched a second
  32. career as an anti-vice crusader a decade ago. He began by
  33. leading a covey of angry citizens in stamping out sex shops in
  34. his own blue-collar neighborhood of Aldine. He then expanded the
  35. drive, harnessing the muscle of police and prosecutors to close
  36. nude bars, massage parlors and so-called modeling studios across
  37. a stretch of Harris County. Today, thanks largely to Hurlbut,
  38. service roads and strips that once glittered with flagrant
  39. fronts for prostitution are clean. Hurlbut is credited as the
  40. prime mover in closing 60 sex shops and preventing dozens of
  41. others from opening.
  42. </p>
  43. <p>    In the battle against sin, a warrior is only as good as his
  44. freshest kill, and that is why Hurlbut is riding shotgun this
  45. gray Friday afternoon during an assault on a trafficker in lewd
  46. videos. At the house, tires screech, and officers leap out with
  47. drawn .45s. "If anything's going to go wrong, it's in the first
  48. two minutes," says Hurlbut, taking it all in from the Chrysler.
  49. Nothing does, but the raid nets only a few small-time video
  50. wholesalers. However, clues quickly lead deputies eight miles
  51. away to a cramped trailer that proves a cornucopia of hard-core
  52. videos and books.

  54. <p>    As investigators gather evidence and make more arrests,
  55. Hurlbut browses through rows of Hefty Mamas, Leg Show, Bizarre
  56. Fantasies and other beckoning titles with the indifference of
  57. a hardened vice cop. "Victimless crime -- crap," he whispers.
  58. "Follow me." The white-haired Hurlbut eases his 225-lb. frame
  59. through an entrance marked PEEP SHOWS and into a darkened warren
  60. of viewing rooms. In each of the empty plywood cubicles, VCRs
  61. still hum, and the trappings of recent sexual activity abound.
  62. "The average guy has no idea what scumbags these places are,"
  63. he snaps.
  64. </p>
  65. <p>    Though the raid is a success, the skin shop is open again
  66. in a matter of hours. That doesn't faze Hurlbut, who has lost
  67. his share of go-rounds with crafty defense lawyers. He'll simply
  68. try again. "Sex shops are like fungus," he says. "If we don't
  69. apply the antibiotic, they'll sprout again anywhere." For
  70. Hurlbut, the medicine involves marshaling public awareness and
  71. applying legal pressure. "We're not on a moral crusade," he
  72. insists. "The porn people are folks like you and me, trying to
  73. make a living. We just want them to obey the law."
  74. </p>
  75. <p>    In the state of Texas, as elsewhere, the laws on
  76. pornography and prostitution are murky. The general benchmark
  77. for defining obscenity is "contemporary community standards."
  78. In Harris County a district attorney's committee helps interpret
  79. that for law-enforcement authorities. Child porn is outright
  80. prohibited. So are publications that display lewd pictures of
  81. genitals and penetration. Alcohol laws are sometimes used as
  82. further controls. For example, nude clubs aren't illegal in
  83. themselves, but they are when they dispense liquor. Hurlbut's
  84. talent lies in knowing just whom to lobby and how to use a
  85. panoply of legal restrictions, including obscure statutes on
  86. public nuisances, to battle smut. Working behind the scenes, he
  87. puts heat on local council members, nudges prosecutors and
  88. lobbies state legislators. He tips cops on new sex shops and
  89. sometimes goes undercover, posing as a customer, in bottomless
  90. joints to gather evidence. He feeds officials other information
  91. gleaned from a network of local eyes and ears he has roused in
  92. speeches to civic groups.
  93. </p>
  94. <p>    There's nothing very imaginative about his strategy, but it
  95. works because of his tenacity. When, for instance, a reluctant
  96. county commissioner failed to move against a nude modeling
  97. studio, Hurlbut brought TV cameras to the site to coax him. When
  98. a prosecutor refused to act on cases, Hurlbut prodded him with
  99. a scathing letter. A soft judge began handing out tougher
  100. sentences after receiving similar mail from Hurlbut and his
  101. allies. When Houston police had trouble combatting an invasion
  102. of Asian modeling studios -- blatant fronts for prostitution --
  103. Hurlbut helped organize a city-county task force.
  104. </p>
  105. <p>    "Dan can get things done that we can't," explains County
  106. Vice Sergeant Nick Griffin. "When he makes a call, things
  107. happen." As Hurlbut sees it, the law-enforcement system does
  108. work: "You just have to kick it, like a bucking horse, into gear
  109. sometimes."
  110. </p>
  111. <p>    It helps to be a police buff and friend to local lawmen.
  112. Hurlbut, who holds membership in the Texas Narcotics Officers
  113. Association, is an expert at working with police and smoothing
  114. out turf battles among enforcement agencies. Three years ago,
  115. he secured a drug dog for sheriff's officers. His annual
  116. backyard barbecue has evolved into a sort of smut fighters'
  117. summit. The mobile phone in his brown Caprice buzzes with calls
  118. from vice cops as he tools down Houston's Airline Drive on a
  119. windy morning. Once a seamy strip of skin palaces, the highway
  120. is now a boring procession of convenience stores and
  121. auto-wrecking yards. Hurlbut points out his triumphs: across
  122. from the Baptist church he attends is the former site of an
  123. infamous massage parlor. He closed it with a little-known
  124. public-nuisance statute. Down the road, another skin house is
  125. shuttered for liquor-code violations. Farther on is a defunct
  126. girlie joint that lost its lease after Hurlbut put the screws
  127. on the property owner.

  129. <p>    Hurlbut's campaign was originally driven by the threat to
  130. property values -- particularly to his own 1 1/2-acre spread --
  131. posed by the encroaching sex shops and bottomless bars, as well
  132. as the fear that the neighborhood was becoming unsafe. Now he
  133. claims a more abstract purpose. "I'm protecting my right to
  134. bitch," he explains. "You've got to get involved, or you don't
  135. have the right to complain."
  136. </p>
  137. <p>    Porn's big profits ensure that Hurlbut will never lack for
  138. work. The station wagon is now deep in the piney woods
  139. northeast of the city as he searches vainly for the site of
  140. another nude bar, one that he has chased from two other
  141. prospective locations. "We'll get him sooner or later," he
  142. chuckles. On the drive home, he wheels up to a fading stucco
  143. relic aside the four-lane. Shut down long ago, the nude club's
  144. blue canopy still flaps amid the weeds and litter, and a garish
  145. neon sign towers skyward. "Twenty warrants for prostitution and
  146. narcotics," he recalls. "Public-nuisance law and county
  147. ordinance. We sent them packing."
  148. </p>
  149. <p>    That, to Hurlbut, is what local activism is all about. "Ten
  150. years ago," he recalls, "people thought this filth was just
  151. something that came with the urban landscape. Now there's a
  152. consciousness that we don't have to stand by and let it happen."
